Terms of Service

These Terms (“Terms”) cover https://recap.camera, the Recap iOS app, the Recap Live Activity extension, and the Recap App Clip when available (together, the “Service”). By using the Service you agree to these Terms. If you do not agree, do not use the Service.

We also have a Privacy Policy at https://recap.camera/privacy (or the current hosted URL for our privacy policy).

Megogigo LLC (“Recap,” “we,” “us”) provides the Service.

1) Who may use the Service

  • You must be 13 or older.
  • If you are under the age of majority in your region, a parent or guardian must accept these Terms for you.
  • You may use the Service on behalf of an organization only if you have authority to bind that organization. “You” includes that organization.

2) Your account

  • Some features require an account using Sign in with Apple or Google Sign-In. Keep your credentials secure. You are responsible for activity on your account.
  • Tell us right away at info@recap.camera if you suspect unauthorized use.
  • We may suspend or terminate accounts that violate these Terms or the law.

3) Purchases and refunds

  • You can buy increased guest capacity for an event through in-app purchases. Prices and taxes are shown in the App Store before you confirm payment.
  • Payments are processed by Apple. Apple’s terms and refund rules apply.
  • Purchases are validated through RevenueCat and linked to your Recap user ID so you can restore purchases.
  • Purchases are final except where required by law or when a technical issue we control prevents use. Email info@recap.camera within 14 days with your transaction ID and a description of the issue.
  • Guest-capacity purchases apply to Recap’s event limits as described in the app. They are not subscriptions unless explicitly labeled as such in the purchase UI.
  • Restore Purchases is available in the paywall flow where supported by RevenueCat and the App Store.
  • Deleting your Recap account does not cancel App Store subscriptions. Cancel in Settings → Apple ID → Subscriptions.

4) Permissions and device access

  • Camera is used when you take a photo or scan an event QR code. Photo library access is used only when you select or save photos. Permissions are controlled by iOS.
  • Push notifications are optional and can be managed in Recap Settings and iOS Settings.
  • Live Activities may show event status on your Lock Screen or Dynamic Island when you participate in an active event.
  • You are responsible for your mobile data and carrier charges.

5) Your content and events

Ownership

You own the photos you upload.

License to Recap

To operate the Service, you grant Recap a worldwide, royalty-free license to host, process, transmit, display, generate thumbnails for, and back up your photos and event data as needed to run the Service.

Event hosts

If you create an event:

  • You control access via invite links, QR codes, or invite codes and can set visibility, participant limits, photo limits, reveal timing, and upload rules.
  • You receive a non-exclusive license to use photos uploaded into your event only for running, viewing, sharing, and exporting that event for personal, event, or internal purposes. Commercial use of a participant’s photo requires permission from the uploader.

Participants

If you join another user’s event:

  • You keep ownership of your photos.
  • You grant the event host the limited license described above.
  • Your photos and display name may be visible to other participants based on the event’s settings.

Do not upload content you do not have the right to share. We may remove content or suspend accounts that violate these Terms or the law.

Not a backup service. Keep your own copies of important photos.

Invite links and previews

Invite URLs (for example https://recap.camera/join/{CODE}) may show limited public preview information so guests can decide whether to join. Do not share invite links with people you do not want to allow access.

6) Acceptable use

Do not:

  • Break the law, violate others’ rights, or upload unlawful, infringing, harassing, hateful, pornographic, or excessively violent content.
  • Upload others’ photos without permission.
  • Attempt to reverse engineer, interfere with, disrupt, or overload the Service.
  • Use bots, scrapers, or unauthorized automation (including abusing public lookup endpoints).
  • Impersonate someone or misrepresent your affiliation.

7) Third-party services

We use vendors such as AWS (S3), RevenueCat, PostHog, Meta (Facebook SDK), Apple, and Google. Their services are provided under their own terms. We are not responsible for third-party websites or materials outside the Service.

8) Intellectual property and feedback

Recap’s name, logos, app design, and Service content (excluding your photos and event content) are owned by Megogigo LLC or its licensors. You may not copy or misuse them except as allowed by these Terms or with our permission.

If you send feedback or suggestions, you grant us a perpetual, royalty-free license to use them without obligation to you.

9) App Store terms

Apple

These Terms are between you and Megogigo LLC, not Apple. Apple is not responsible for the app. Apple has no duty to provide support. If the iOS app fails to conform to any applicable warranty, you may notify Apple for a refund of the app price, if any. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

Apple’s standard EULA

For iOS downloads, Apple’s Licensed Application End User License Agreement applies. If there is a conflict, the Apple EULA controls to the extent required by Apple.

10) DMCA notice

If you believe content on the Service infringes your copyright, email info@recap.camera with a DMCA notice that includes: (1) your contact info, (2) the work claimed infringed, (3) the specific URL or location of the material, (4) a good-faith statement that the use is not authorized, (5) a statement under penalty of perjury that your notice is accurate and you are the owner or authorized agent, and (6) your physical or electronic signature. We may terminate repeat infringers.

11) Disclaimers

The Service is provided “as is” and “as available.” To the fullest extent allowed by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Some regions do not allow disclaimers; you may have rights that cannot be waived.

12) Limitation of liability

To the extent not prohibited by law: (a) we will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages; and (b) our total liability for any claim is limited to the amount you paid to Recap for the Service in the 6 months before the claim. These limits apply even if a remedy fails its essential purpose.

13) Indemnity

You will defend and hold Megogigo LLC harmless from claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of your content, your use of the Service, or your violation of these Terms or the law.

14) Termination

You may stop using the Service at any time. We may suspend or terminate your access, or remove content, if we believe you violated these Terms or the law. Sections that by their nature should survive termination do survive.

15) Changes to these Terms

We may update these Terms. If we make material changes, we will notify you in-app or by email when appropriate. Continued use means you accept the new Terms.

16) Governing law; arbitration; class waiver

Governing law. California law governs these Terms, without regard to conflict-of-law rules. The Federal Arbitration Act (FAA) governs the arbitration agreement below.

Informal resolution. Before filing a claim, you and Recap will try to resolve it informally. Email info@recap.camera with “Dispute” in the subject. If not resolved in 30 days, either party may file.

Arbitration. Any dispute relating to the Service will be resolved by binding individual arbitration administered by JAMS under its rules, before one arbitrator. Hearings may be held by video/phone or, at your choice if you are a U.S. consumer, in your county of residence. Judgment may be entered in any court with jurisdiction.

Exceptions. (a) Small-claims cases may proceed in small-claims court in your county of residence or Sacramento County, California. (b) Claims seeking only public injunctive relief, and (c) intellectual-property disputes, may proceed in court.

Class waiver. No class actions or class arbitrations. The arbitrator may not consolidate claims.

Opt-out. You may opt out of arbitration and the class waiver by emailing info@recap.camera within 30 days of first accepting these Terms, stating your name, account email, and a clear request to opt out. If you opt out, neither you nor Recap will be bound by this Section for future disputes.

17) Other terms

  • Export. You must comply with U.S. export laws and may not use the app in embargoed countries or by prohibited parties.
  • Assignment. We may assign these Terms. You may not assign without our consent.
  • Severability. If a term is unenforceable, the rest remain in effect.
  • No waiver. A failure to enforce a term is not a waiver.
  • Language. The English version controls.
